GoCoachly Terms of Service

Welcome to Coachly! These Terms of Service (“Terms”) govern your use of our software-as-a-service platform (“Platform” or “Service”) operated by Alumco.io FZ-LLC (“Coachly,” “we,” “us,” or “our”).
By signing up, accessing, or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. Account & Eligibility
- You must be at least 18 years old to create a Coachly account.
- You must provide accurate information and keep your account credentials secure.
- You are responsible for all activity under your account, including by your clients or team members.
- You must not use the Service for unlawful purposes or to transmit harmful content (malware, viruses, etc.).
- Coachly reserves the right to suspend or terminate accounts at its sole discretion for violations.
2. Use of Service
Coachly provides tools for coaches to manage clients, receive inputs (like goals, calendars, transcripts), and generate AI-driven insights.
You agree not to:
- Reproduce, resell, or exploit any part of the Service without written permission.
- Reverse engineer, decompile, or modify the Service.
- Use the Service in a way that violates intellectual property rights or applicable laws.
- Use the Service to process or store sensitive health data (e.g., HIPAA-regulated data) without our prior consent.
3. Payments & Billing
- Plans are billed in advance, either monthly or annually, based on your subscription.
- All payments are final and non-refundable unless otherwise stated.
- Coachly reserves the right to update pricing. We will provide notice ahead of any changes.
- If your payment fails, we may suspend access after a grace period.
4. Free Trial
- Coachly may offer free trials. After the trial ends, continued access requires a paid plan.
- If you don’t upgrade before your trial expires, your data may be deleted after a set retention window.
5. Data Ownership & Privacy
- You retain ownership of the content and data you submit to the platform.
- We process user data to deliver insights, track progress, and improve the platform.
- Our use of personal data is governed by our Privacy Policy.
- Coaches are considered data controllers of their client data. Coachly acts as a data processor.
6. Termination & Cancellation
- You may delete your account at any time via your dashboard or by contacting support.
- Access will continue until the end of your billing period.
- Upon termination, we will retain your data for up to 12 months unless you request deletion earlier.
7. Service Availability
- While we aim for high uptime, Coachly does not guarantee uninterrupted access.
- We may schedule maintenance or experience outages due to unforeseen issues.
- We will use reasonable efforts to notify users in advance of planned downtime.
8. Intellectual Property
- Coachly owns all rights to the platform software, design, and branding.
- You grant us permission to use your logo or name for marketing purposes, unless you opt out by emailing us.
- You must not imply affiliation with Coachly unless authorized.
9. Disclaimers
The Service is provided “as is.” We do not guarantee:
- The Service will meet your specific expectations.
- That data, insights, or AI outputs will always be error-free.
- That features will be available at all times or meet any minimum uptime.
To the extent permitted by law, we disclaim all warranties, express, implied, or statutory.
10. Limitation of Liability
Coachly is not liable for:
- Lost profits, data loss, or indirect damages.
- Service interruptions or data access issues.
- Content or conduct of users on the platform.
Our total liability in any 12-month period is limited to the amount paid to Coachly during that period.
11. Indemnity
You agree to indemnify and hold Coachly harmless from claims arising out of:
- Your use of the Service
- Your content or conduct on the platform
- Any breach of these Terms by you or your users
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will notify you via email or in-app notification. Continued use of the Service means you accept the updated terms.
13. Governing Law
These Terms are governed by the laws of the United Arab Emirates. Disputes will be resolved under the jurisdiction of Dubai courts, unless otherwise required by law.
